User Agreement
By commissioning me, you are confirming to have read my terms of service and to have accepted all the terms described herein.
You will agree here to the policy of using the art for personal, non-profit purposes unless otherwise stated, and provide all image credits to me.
Violators will be added to a blacklist indefinitely without any warning with any additional appropriate actions taken.
General
Client
Unless explicitly agreed upon otherwise, all work commissioned from Mousekey is solely for personal use (i.e., posting on social media with credit, using as profile pictures/headers, personal printing, etc).
If the client intends to use commissioned work for commercial purposes (i.e., advertising, streaming, merchandise, etc) this must be disclosed at the beginning of the commission process and may affect the final cost.
The client agrees to credit me (Mousekey) as the artist of any commissioned work.
The client does not have the right to alter, modify or trace any commissioned work without my explicit permission.
The client is prohibited to claim any art, commissioned or otherwise, as their own or to post them in galleries/portfolios intended to display their own artwork.
Clients are not permitted under any circumstances to use any work commissioned or otherwise from Mousekey, or any part of it in the use or training of neural networks or artificial intelligence of any kind. Use related in anyway to NFTs, cryptocurrencies, web3 and other related spaces is also prohibited.
Clients who have commissioned and/or received work before this TOS has gone into effect are still bound to its contents.
Artist
As the artist, I retain the copyright of the commissioned artwork.
I reserve the right to use, publish, or record the commissioned artwork and its process unless agreed upon otherwise.
If commissioned for fanart of an existing series or franchise, I reserve the right to sell the artwork at any given point, such as prints or in art books.
I reserve the right to decline any project or client for any reason.
I reserve the right to refund you the full amount paid if I no longer wish to work on your project for any reason.
Commercial Use Agreement
If the client wishes to commission art to use commercially, the total price of the commission, as well as any extra fees or royalties if I see fit, will be discussed and agreed upon upfront.
The minimum price increase will be 50% of the base commission price, though this may increase according to my discretion.
Commercial use includes but is not limited to: promotional use for online content creators or brands, branding assets (video thumbnails, stream assets, promotional art to be reposted on social media), merchandise production for sale (keychains, stickers, prints, standees, etc.), using the commission in any way that leads to profiting monetarily (including promotion).
I retain the rights to all commissioned artwork. The client will agree to continue to credit me as the original artist.
Payment
Payment must be made in full and upfront through PayPal invoice and in GBP (£).
Once work is started on a commission, no refunds will be accepted unless something happens on my part.
Process & Delivery
I may take up to a week to respond to initial commission inquiries.
I may not start work on your commission immediately and do not accept rush fees. If you have a certain date you would like your commission ready by, please discuss this with me and I will see if I am able to accommodate.
Orders may take up to 2 months to finish from starting date depending on complexity of the commission and my current workload.
You are free to ask me how a commission is going at any time, or check my public commission progress on Trello. Clients who wish to keep their commission private will not be named on the Trello board.
You reserve the right to be notified of any major delays with your commission.
I may work on personal art or other projects in between commissions.
No harassment over my work speed will be tolerated, regardless of the time that has passed.
Due to variation of difficulty and time necessary for different requests, commissions may not be completed in chronological order.
There will be 4 main check-ins during the commission process; the initial sketch phase, the line art/flats stage, the rendering stage and the final.
I will only accept major revisions in the sketch phase so please ensure you are happy with the direction the piece is going. I may accept certain revisions during the line art stage, but from the rendering stage onward I will only make minor adjustments (e.g., colours, small details, etc).
The final piece will be delivered via email.
The standard final product will be in png format, minimum 2500x2500px. Accomodations can be made.
The product is a digital good and will not be physically sent to the client.
